are you familiar with internet rule 34? Even if in this case it's an item that enables a gender swap, the internet will turn everything into porn anyway. So if you put responsibility on the game designer, then every company would have to fire all employees after their first game. I would guess that Nintendo is even happy with the publicity, I wouldn't have known about their announcements without this meme...

I feel like it'd be better if Bowsette had deep-red hair instead, despite the nature of the crown. Makes more sense to me. Maybe even add a few patches of green scales here and there, like how some depictions of Lamia do. This is still cute regardless.

I would probably assume a genderbent version of an existing character falls outside the boundaries of "original character do not steal".

Honestly if Nintendo really wanted to go all in on the publicity, they would copyright strike the original Bowsette image. This would raise an internet shitstorm, gaining them publicity. Of course the side effect is making them look like a villain, so... give and take.

Interestingly enough, there's concept art in the official Super Mario Odyssey artbook that has Bowser use his own cap to take control of Peach, making a sort of Peach Koopa before Bowsette existed.

Its true they are not gonna go for a bowser that becomes female via magic - but I can easily see them just making a female version of bowser - like they are from an alt reality or whatever that they don't need to explain - the same way they have Linkle.
