Using photos instead of drawings for backgrounds is actually pretty common. Most likely they were done by author that is why it is legit.

I feel like this is one of the few instances where copyright law makes sense.

From what I heard about Shou case it sound like totally bs, but yea, sometimes instead of drawing background from the ground artist just make a photo and edit it a little. The issue with Shou was that instead of making his own, he picked work of some other artist without crediting/asking them for permission. Still it isn't like he did no work. After all he redrawn entire damn thing from it and it isn't like those poses were super mega unique and he couldn't just draw them by coincidence. I don't have all info so I can't judge if he deserved it or not. Anyway, unless that author stolen those pictures from somewhere else, there is no issue with stuff like that.

From what I gather Shou was caught for tracing glamour photography, the sort of thing the photographer makes a living off of, and is very invested in protecting their copyright. Going out and taking pics of Tokyo or wherever it happens to be and making alterations to fit as backgrounds is definitely a different sort of thing both from a copyright and an ethical point of view.

From what I gather the use of photos in manga backgrounds is very common, at least in stuff that takes place in realistic urban settings. But the use of traced photos for character art is frowned upon, and the use of traced copyrighted glamour photos is even more so. Not to mention, it presents a pretty obvious black eye to the magazine within the publishing industry, so you can see why they'd discourage it.

I must say the backgrounds in this are kind of hard on my eyes, since the difference between the altered photos and obviously hand-drawn elements (like the gate on page 5) is kind of jarring. There's definitely stuff in the backgrounds and foregrounds that aren't photos, which throws me off.

Yea, I had the same issue. Some panels are hard to look at. It really could be done better. Using photos without much changing was too much of a shortcut I guess.

Tracing photos and having it come out well takes a lot more skill than people think. For people especially, but bakgrounds too.
