The mangaka have to file a complaint first. I think only the most pissy and self-absorbed would do this. Doujinshi circles are fans of the series they do manga of as well. Complaining about them would only kill your fanbase.

Didn't the article say that "third party" people could file the complaint instead? Although I'm not sure whether the mangaka have the final say in whether that complaint goes anywhere.

That said, I think there'll be lots of opposition to that particular part of the trade deal, both from the fans and the mangaka.
